Harvey Updyke, Man Who Poisoned Toomer’s Corner, To Be Released From Jail Monday

Auburn Tigers fans are not going to like to hear this, but Harvey Updyke is set to be released from jail on Monday, according to al.com. If you were living under a rock — or perhaps a poisoned tree — Updyke is the Alabama Crimson Tide fan that poisoned the iconic oak trees on Toomer’s Corner.

Updyke was charged with one count of unlawful damage of an animal or crop facility and has served up part of his three-year split sentence that he got as a result of his guilty plea. Once out of jail, Updyke will be placed on five years of supervised probation.

Don’t worry, Auburn fans, Updyke can’t cause anymore harm.

As part of the plea deal, Updyke is unable to attend any college sporting event and he has banned from any Auburn University property. He is also unable to speak with the media. There will also be some financial ramifications for Updyke as the Lee County District Attorney’s Office will seek more than $1 million in damages.

The poisoning of the oaks at Toomer’s Corner was one of the most publicized acts from the Alabama – Auburn rivalry, and it was covered in depth on the ESPN 30 for 30 episode, “Roll Tide, War Eagle,” which you can watch here on Netflix.
